A Parte em cujo território o presente Acordo for assinado, no mais breve prazo possível após a sua entrada em vigor, submetê-lo-á para registo junto do Secretariado das Nações Unidas, nos termos do artigo 102.º da Carta das Nações Unidas, devendo, igualmente, notificar a outra Parte da conclusão deste procedimento e indicar-lhe o número de registo atribuído.
Feito em Lisboa, aos 11 dias do mês de Fevereiro de 2009, nas línguas portuguesa, moldova e inglesa, fazendo todos os textos igualmente fé.
Em caso de divergência de interpretação, prevalecerá a versão inglesa.

AGREEMENT BETWEEN THE PORTUGUESE REPUBLIC AND THE REPUBLIC OF MOLDOVA ON COOPERATION IN THE FIELD OF TOURISM
The Portuguese Republic and the Republic of Moldova hereinafter referred to as «the Parties»:
Wishing to contribute to the development of the tourist relationship between the Portuguese Republic and the Republic of Moldova, as well as to the co-operation in the field of tourism between the two countries;
Conscious of the importance that the development of the tourist relationship may have, not only in favor of the respective economies, but also to increase the knowledge, the understanding and the relationship between the two peoples;
Recognizing the need to establish a legal framework in order to stimulate the cooperation in the field of tourism between the two countries;
have agreed as follows:
Article 1
Subject
The present Agreement establishes the legal framework for the development of the institutional and entrepreneurial cooperation between the Parties in the field of tourism, at the level of:
a) The exchange of information;
b) The professional training;
c) The tourism promotion;
d) The investment promotion;
e) The entrepreneurial cooperation.
Article 2
Exchange of information
The Parties shall promote the exchange of information on the tourist activity, including legislation, statistic data, programmes of tourist development, as well as projects and tourist products, specially those based on technological innovation.
Article 3
Professional training
The Parties shall endeavour to create the conditions to cooperate in the field of professional training, having in mind:
a) The professional training of experts of the tourism sector;
b) The exchange of experts and specialized personnel;
c) The development of cooperation between the institutions of both countries responsible for research in the field of tourism.
Article 4
Tourism promotion
The Parties shall promote, in a regular basis, the exchange of experiences in domains related with the commercialization of tourist products.
Article 5
Investment promotion
The Parties shall encourage Portuguese, Moldovan or joint ventures investments in the field of tourism.
Article 6
Entrepreneurial cooperation
The Parties shall create the favorable conditions for the cooperation between their enterprises, namely in what concerns the information on investment opportunities of each country, concerning:
a) The construction of new equipments, as well as to the recovering of the existent ones;
b) The development, management and protection of natural and cultural tourist resources.
Article 7
Joint commission
1 - The Parties shall create a joint commission in order to promote, develop and implement the cooperation foreseen in the present Agreement.
2 - The joint commission shall be composed by representatives of the institutions responsible for the tourism sector of both Parties, having the following competences:
a) Discuss and propose solutions for the existent problems and elaborate recommendations to estipulate the tourist cooperation;
b) Solve the disagreements resulting from the implementation or application of the present Agreement.
Article 8
Settlement of disputes
Any dispute concerning the interpretation or application of this Agreement, not solved in the context of the joint commission, shall be settled through consultation or negotiation by diplomatic channels.
Article 9
Amendments
1 - The present Agreement may be amended on request of one of the Parties.
2 - The amendments shall enter into force in accordance with article 13 of the present Agreement.
Article 10
Expenses
Expenses for the implementation of the present Agreement should be covered by the Parties according to the budget provided for this matter.
Article 11
Relation with other international instruments
The provisions of the present Agreement shall not affect the rights and obligations arising from other international instruments which both are Parties.
Article 12
Duration and termination
1 - The present Agreement shall remain in force for a period of five (5) years, automatically renewed for identical periods.
2 - Each Party may, at any time, terminate the present Agreement.
3 - The termination shall be notified, in writing, through diplomatic channels, producing its effects six (6) months after the date of reception of the respective notification.
4 - In case of termination, any program or project initiated while the present Agreement was in force shall be concluded, unless the Parties agree otherwise.
Article 13
Entry into force
The present Agreement shall enter into force thirty (30) days after the date of receipt of the last notification, in writing and through diplomatic channels, stating that all the internal procedures of both Parties necessary for its entry into force have been fulfilled.
Article 14
Registration
The Party in whose territory the present Agreement is to be signed, in the shortest possible time after its entry into force, shall submit it for registration to the United Nations Secretariat, in the terms of article 102 from the Chart of the United Nations, having also the duty to notify the other Party of the conclusion of this procedure, indicating its registration number.
Done at Lisbon, on the eleventh day of February 2009, in the Portuguese, Moldovan and English languages, each texts being equally authentic.
In case of any divergences of interpretation, the English shall prevail.
