Este Acordo vigorará por um período de cinco anos. Depois disso, será automaticamente renovado por períodos sucessivos de cinco anos, a menos que seja denunciado por escrito, através dos canais diplomáticos, por qualquer das Partes, seis meses antes de expirar cada período.
Em caso de denúncia deste Acordo e por força do disposto neste artigo, cada programa de intercâmbio, entendimento ou projecto em curso com base nas cláusulas deste Acordo permanecerá válido até à sua conclusão.
Cada Parte Contratante poderá requerer, por escrito, a emenda da totalidade ou parte do presente Acordo. Qualquer emenda que tenha sido acordada pelas Partes Contratantes entrará em vigor segundo as disposições do artigo 20.º do presente Acordo.
Em fé do que os abaixo assinados, estando devidamente autorizados, assinaram o presente Acordo.
Feito em Lisboa, aos 14 de Abril de 1998, em dois exemplares originais nas línguas portuguesa, croata e inglesa, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, prevalecerá o texto em língua inglesa.

AGREEMENT BETWEEN THE PORTUGUESE REPUBLIC AND THE REPUBLIC OF CROATIA ON CO-OPERATION IN THE FIELDS OF CULTURE, EDUCATION AND SCIENCE.
The Portuguese Republic and the Republic of Croatia (hereinafter the Contracting Parties):
Desiring to develop co-operation between the two countries in the fields of culture, education and science;
Convinced that such co-operation will contribute to better mutual understanding and enhancement of relationship at different levels;
Resolved to respect the principles of the Helsinky Final Act of the Conference on Security and -Co-operation in Europe and the Paris Charter for a New Europe:
have agreed as follows:
Article 1
The Contracting Parties shall encourage and facilitate, on the basis of mutual benefit, exchanges and co-ope-ration between the two countries in the fields of culture, education, science and technology and provide appropriate opportunities for contacts and joint activities between the organizations, institutions and persons active in these fields.
The Contracting Parties shall encourage the com-petent bodies and institutions of their respective countries to consider activities that may include among others:
1) Exchange of exhibitions and other displays of cultural, educational and documentary nature as well as information on the life, natural conditions and history of each other's country;
2) Translation and publication of artistic, literary and scientific work produced in the other country;
3) Presentation of plays and musical compositions of the other country;
4) Distribution and screening of feature, documentary and educational films of the other country as well promotion of other mutually beneficial activities in the fields of cinematography, radio and television;
5) Performances of artistic groups and individual artists;
6) Participation in international conferences, festivals, competitions and other cultural events organized in both countries;
7) Exchange of experts in the fields of literature, dance, music, painting, sculpture, theatre and other areas of the arts;
8) Co-operation in the fields of common interest between universities and other institutions of higher education, as well as between cultural organizations;
9) Exchange of books, text-books, periodicals and other documentary material;
10) Co-operation in the organization of joint research, conferences and symposia.
Article 2
The Contracting Parties shall encourage the exchange of teachers, professors and lecturers, the granting of scholarships and the facilities of exchange of undergraduate and postgraduate students.
Both Contracting Parties shall also exchange text-books, curricula as well as pedagogical and educational methodology materials.
Article 3
The Contracting Parties shall encourage the study of the Portuguese and Croatian languages respectively in their countries.
Article 4
The Contracting Parties shall develop co-operation between the public archives, libraries and museums according to the legislation valid in either country.
Article 5
The Contracting Parties shall promote the development of contacts between researchers of both countries, in the fields of protection and preservation of cultural heritage (monuments and historical buildings) and mo-vable cultural property. As to protection of national heritage of each country both Parties shall take all appropriate measures in order to prevent illicit export of mo-vable cultural goods as well as to ensure their return to the country of origin in case of illicit export.
Article 6
The Contracting Parties shall, in accordance with the aims of this agreement, encourage the establishment of contacts and co-operation between institutions, organizations or persons in both countries in the fields covered by this Agreement.
To this end, the Contracting Parties shall encourage:
a) Co-operation in various fields of science, including the exchange of scientists, the implementation of joint research and development projects, the organization of joint scientific seminars, conferences and other scientific meetings, the exchange of publications and information and any other form of co-operation which may be mutually agreed upon between the Contracting Parties or relevant non-governmental institutions in both countries;
b) Co-operation in the field or technology, especially supporting and encouraging the transfer and development of new technologies;
c) Co-operation in the fields of marine biology and related technologies as well as research to environmental protection and ecology of the sea.
Article 7
In accordance with binding international conventions and agreements in the field of intellectual property, the Contracting Parties may become, within their respective laws and regulations, joint legal owners of intelectual property rights resulting from the activities arising out of this agreement.
Subject to prior mutual agreement on all relevant aspects, the contracting parties may register industrial property rights in accordance with their respective industrial property laws and, denote copyrights in accordance with their copyrights laws.
Article 8
The Contracting Parties shall support reciprocal recognition of diplomas, titles and academic degrees awarded by their higher educational institutions, by means of entering into separate agreements in which the conditions and requirements for equivalence will be stated.
Article 9
Each Contracting Party shall support joint activities including access to the specific documentation and the establishment of joint commissions for the correct presentation of the history, geography, culture, social and economic development of its country in the school text-books, university programmes, encyclopaedias and other publications published in the other country.
Article 10
The Contracting Parties shall promote active co-ope-ration within UNESCO and other international organizations in the fields of culture, education and science.
Article 11
The Contracting Parties shall encourage co-operation between the news agencies and press organizations of the two countries, direct contacts between publishers of newspapers and periodicals as well as the exchange of journalists and press correspondents.
Article 12
The Contracting Parties shall encourage the participation of representatives in the radio-television area in international competitions, festivals, congresses, etc., that could be organized respectively in Portugal and Croatia.
The Contracting Parties shall contribute to the expansion of contacts and co-operation between the public radio and television organizations according to the le-gislation valid in either country.
Article 13
The Contracting Parties shall encourage co-operation in the fields of sport and physical education. They will to establish direct contacts and close cooperation between their respective sports authorities. The contents and details of this co-operation will be decided upon directly between the above mentioned authorities.
Article 14
The Contracting Parties shall encourage contacts between young people and direct co-operation between youth organizations of the two countries.
Article 15
Within the terms of the laws and regulations in force in its territory, each Contracting Party shall grant to the other every reasonable facility for the entry, stay and departure or persons, and for the importation of the material and equipment necessary for carrying out the programmes or exchanges which may be established in accordance with this agreement.
Article 16
The Contracting Parties may establish mutually cultural centres in their respective capitals, the legal status and the terms of organization and functioning of which will be regulated by a special interstate agreement.
Article 17
The present agreement does not exclude the possibility of establishing other forms of bilateral co-ope-ration in other fields related to it or corresponding to its objectives.
Article 18
The Contracting Parties agree to establish a joint commission to facilitate the implementation of this agreement, to discuss the issues that might arise from the application of this agreement and to take all the necessary recommendations for the achievement of its objectives.
The joint commission, consisting of equal number of representatives from both Contracting Parties, shall meet when considered appropriate by mutual agreement, alternatively in Portugal and Croatia. This joint commission may, whenever necessary, establish working groups.
Article 19
This agreement shall not in any way prejudice the rights and obligations of existing and future bilateral or multilateral agreements and shall have no effect on the rights and obligations of the Parties derived from such agreements or other international agreements to which they may or will be a party.
Article 20
This agreement shall enter into force at the date of the last notification of the accomplishment of each party's constitutional requirements.
Article 21
This agreement shall remain in force for a period of five years. It shall thereafter be automatically renewed for a successive period of five years unless denounced in writing through diplomatic channels by either Party six months prior to the expiry of any one period.
In case of denounciation of this agreement and in accordance with the provisions of this article, each programme of exchange, understanding or project initiated on the basis of this agreement and still in progress, shall remain valid until its completion.
Each Contracting Party may request in writing amendment of all or parts of this agreement. Any amendment which has been agreed to by the Contracting Parties shall enter into force in accordance with article 20 of the present agreement.
In witness whereof, the undersigned, duly authorized, have signed this agreement.
Done at Lisbon on the 14th April 1998 in two original copies in the Portuguese, Croatian and English languages, all texts being equally authentic. In case of divergency of interpretation, the text in the english language shall prevail.
